Welcome to blueberRE. These Terms of Service govern your access to and use of the blueberRE website, platform, mobile application, and related services. By accessing or using blueberRE, you agree to these Terms. If you do not agree, please do not use the website, app, or services.

1. About blueberRE

blueberRE provides a platform designed to help real estate professionals host, request, match, track, and manage open house and showing-related activity. blueberRE may provide tools for scheduling, communication, location tracking, status updates, and related administrative features.

blueberRE is a technology platform. Unless expressly stated otherwise, blueberRE is not a real estate brokerage, broker, agent, employer, insurer, or legal advisor. Users are responsible for complying with all real estate licensing laws, brokerage policies, MLS rules, professional standards, and applicable local, state, and federal laws.

2. Eligibility

You must be at least 18 years old to use blueberRE. By using the platform, you represent that you have the authority and legal capacity to agree to these Terms.

If you use blueberRE on behalf of a company, brokerage, team, or organization, you represent that you are authorized to bind that entity to these Terms.

3. Real Estate Professional Responsibilities

Users are solely responsible for making sure their use of blueberRE complies with all professional, legal, brokerage, MLS, association, board, and licensing requirements.

You agree that you will not use blueberRE to perform any activity you are not legally or professionally authorized to perform. You are responsible for confirming whether you may host, show, access, enter, market, represent, or provide services related to a property.

blueberRE does not verify or guarantee that any user is properly licensed, qualified, insured, authorized, or approved to perform any real estate-related service unless expressly stated in writing.

4. User Accounts

You may be required to create an account to access certain features. You agree to provide accurate and current information and to keep your login credentials secure.

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you should contact blueberRE promptly.

blueberRE may suspend or terminate accounts that violate these Terms, misuse the platform, provide false information, create safety concerns, or engage in conduct that blueberRE determines is harmful to the platform or other users.

5. Hosting, Requests, Matching, and Tracking

blueberRE may allow users to request hosting assistance, accept hosting opportunities, track open house or showing activity, update status, and communicate with other users.

blueberRE does not guarantee that a host, request, match, showing, open house, payment, or opportunity will be available, accepted, completed, successful, or free from error.

Users are responsible for confirming all property access instructions, safety procedures, lockbox information, brokerage approvals, client communications, compensation arrangements, and any other requirements before participating in any open house or showing-related activity.

6. Payments and Payouts

If blueberRE offers paid services, hosting compensation, subscriptions, transaction fees, or payouts, the applicable payment terms will be presented at the time of purchase, enrollment, request, or transaction.

You agree to provide accurate payment and payout information. blueberRE may use third-party payment processors to process payments and payouts. blueberRE is not responsible for delays, errors, fees, account limitations, or actions caused by third-party payment providers.

Any applicable taxes, reporting obligations, licensing obligations, or business expenses related to payments received through BlueberRE are the sole responsibility of the user receiving payment.

7. No Guarantee of Results

blueberRE does not guarantee any specific business result, income, lead, transaction, client, showing, sale, listing, buyer, seller, open house attendance, or professional outcome.

Any examples, descriptions, or marketing materials are provided for general informational purposes only and should not be interpreted as a promise of results.

8. User Conduct

You agree not to use blueberRE to:

• Violate any law, regulation, MLS rule, brokerage policy, or professional standard.
• Misrepresent your identity, license status, qualifications, affiliation, or authority.
• Access a property without proper authorization.
• Harass, threaten, abuse, discriminate against, or harm another person.
• Upload false, misleading, unlawful, or infringing content.
• Interfere with the security, functionality, or availability of the platform.
• Attempt to reverse engineer, scrape, copy, or exploit the platform.
• Use the platform for fraudulent, unsafe, deceptive, or unauthorized purposes.

9. User Content

You may be able to submit, upload, or share content through blueberRE, including profile information, messages, property-related information, notes, photos, status updates, or other materials.

You retain ownership of your content, but you grant blueberRE a non-exclusive, worldwide, royalty-free license to use, host, store, display, reproduce, and process your content as necessary to operate, improve, promote, and provide the platform.

You are responsible for the accuracy, legality, and appropriateness of any content you provide.

10. Location and Tracking Features

blueberRE may include location-based or tracking features to help support hosting, status updates, verification, or operational transparency.

By using features that rely on location services, you consent to the collection and use of location information as described in our Privacy Policy and any in-app notices. You are responsible for enabling or disabling location permissions through your device settings.

Location data may not always be accurate, complete, current, or available. blueberRE does not guarantee the accuracy of any tracking or location-based feature.

11. Third-Party Services

blueberRE may link to or integrate with third-party services, including app stores, payment processors, mapping providers, analytics tools, communication services, and other vendors.

blueberRE is not responsible for third-party websites, apps, services, policies, content, fees, errors, outages, or practices. Your use of third-party services may be governed by separate terms and privacy policies.

12. Intellectual Property

The blueberRE name, logo, website, app, design, text, graphics, icons, software, and other materials are owned by blueberRE or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from BlueberRE materials without prior written permission.

13. Privacy

14. Availability and Changes to the Platform

16. Limitation of Liability

To the fullest extent permitted by law, blueberRE and its owners, officers, employees, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, property-related claims, personal injury claims, or damages arising from your use of or inability to use blueberRE.

To the fullest extent permitted by law, blueberRE’s total liability for any claim related to the platform will not exceed the amount you paid to blueberRE, if any, during the three months before the claim arose.

17. Indemnification

You agree to defend, indemnify, and hold harmless blueberRE and its owners, officers, employees, contractors, partners, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the platform, your violation of these Terms, your violation of applicable laws or professional rules, your content, or your interactions with other users or third parties.

blueberRE may suspend or terminate your access to the platform at any time if we believe you have violated these Terms, created risk, misused the platform, or engaged in conduct that may harm blueberRE, users, clients, properties, or third parties.

You may stop using BlueberRE at any time.
