Welcome to BlueberRE LLC
Your privacy is important to us. BlueberRE LLC (“BlueberRE,” “we,” or “us”) provides the blueberRE mobile platform that enables active, licensed real estate agents in the United States and Canada to connect listing agents with host agents to cover open houses and showings. This Privacy Policy explains how we collect, use, disclose, store, protect, and otherwise process your personal information when you access or use our mobile application, website, APIs, software, and related services (collectively, the “Platform”).
This Privacy Policy applies to users located in the United States and Canada. Certain rights and disclosures may vary depending on your province, state, or other applicable law.
By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy.
1. Scope
This Privacy Policy applies to all users of the Platform. This Platform is currently intended solely for active, licensed real estate agents and authorized real estate professionals over the age of 18 years old, including:
- Listing agents
- Host agents
- Other active, licensed real estate agents
- Real estate professionals authorized to use the Platform
- Brokerage personnel authorized to use the Platform
- Visitors to our website
- Prospective users who are licensed real estate agents
- Authorized business or brokerage account holders
This Privacy Policy does not apply to third-party websites, applications, or services that maintain their own privacy policies.
2. Information We Collect
Depending on how you use the Platform, we may collect the following categories of information.
A. Account Information
When you create an account, we may collect:
- First and last name
- Email address
- Phone number
- Username
- Password (stored using industry-standard security practices and never displayed in plain text)
- Profile photograph (not used for facial recognition, facial comparison, or biometric verification unless we update this Privacy Policy and provide any required notice)
- Real estate license number and issuing state
- Brokerage name
- Brokerage office address
- Account settings and preferences
- Mailing address
B. License Verification Information
To confirm that you are an active, licensed real estate agent, we manually verify license information you provide. In connection with verification, we may collect:
- Real estate license number
- Issuing state or province of your license
- Brokerage affiliation
- Manual active-license verification status
- Verification status
- Other reasonably necessary information to verify your active license
- Phone number
- Email address
Verification is performed manually, is intended to improve trust on the Platform, and is not a guarantee of a user’s identity, qualifications, or conduct. Until your active license status is confirmed by our admin, your account may be placed in a review status with limited functionality. In certain circumstances, we may contact you directly and ask you to provide identification or other documentation to confirm your active license status. Any identification or documentation collected for this purpose is used solely to verify your active license status and is not used for facial recognition, facial comparison, or biometric verification.
C. Property Information
In connection with open house and showing appointments, we may collect:
- Property address
- Appointment details
- Availability
- Appointment status (such as requested, confirmed, or completed)
- Cancellation, no-show, and completion information
- Open house and showing details
- Notes
- Showing preferences
- For a listing, the Platform collects only the property address and does not collect listing photographs or listing descriptions.
D. Communications
When you use Platform communication features, we may collect:
- Messages between matched listing agents and host agents
- Appointment requests
- Support tickets and customer support communications
- Photos attached to messages
- Star ratings
- Feedback you choose to provide
- Other content you voluntarily submit through currently available Platform features, such as appointment-related notes or support communications
Sensitive Property-Access Information
Matched listing agents and host agents may exchange messages and photos through the Platform. Messages, appointment notes, and other user-submitted content may contain sensitive property-access information, such as lockbox codes, gate codes, alarm codes, security codes, access instructions, security instructions, or similar information.
You should avoid sharing unnecessary sensitive information, should only submit property-access information you are authorized to share, and are responsible for the content you submit through the Platform. BlueberRE may access, use, or disclose messages, photos, and property-access information as reasonably necessary to operate, secure, support, or enforce the Platform, comply with law, respond to user reports or support requests, or address suspected misuse.
E. Payment Information
If you make or receive payments through the Platform, payment-related information is collected and processed by our third-party payment processor, Stripe. BlueberRE does not receive or store your full payment card number.
F. Device Information
We may automatically collect:
- IP address
- Device model
- Operating system
- Mobile carrier
- Browser type
- Device identifiers
- Crash reports
- Diagnostic information
- Language preferences
- Time zone
G. Usage Information
We may collect information regarding how you interact with the Platform for basic administrative analytics and reporting, including:
- Pages viewed
- Buttons selected
- Features used
- Search history within the Platform
- Session duration
- Clickstream information
- Referral sources
H. Location Information
With your permission, we may collect:
- GPS location
- Approximate location
- Precise address location
- Device-derived location
- Appointment location
- Live location movement during hosting
Location information is used only to provide hosting and live-tracking features, to match listing agents with host agents, and to facilitate open house and showing appointments. We do not use your location information for safety features, fraud prevention, analytics, customer support, advertising, or marketing purposes.
You may disable location permissions through your device settings, although some Platform features may not function properly.
Precise, Background, and Live Location Tracking
When you accept a hosting appointment and act as a host agent, BlueberRE collects precise location and background (“Always”) location to provide live tracking during that appointment. Live location tracking is limited to the active hosting appointment and stops when the appointment is completed.
During this active tracking period, we may collect your location even when the app is closed, minimized, running in the background, or otherwise not actively open on your screen. Location tracking during a hosting appointment is limited to that active period and stops when the host taps “Done.”
The host’s live location during a hosting appointment is shared only with the listing agent for that specific appointment. We do not share live location with other users.
We use location only for hosting, live tracking, and matching listing agents with host agents. We do not use location for safety features, fraud prevention, analytics, customer support, advertising, or marketing.
You may grant, deny, or revoke location and background-location permissions at any time through your device settings. Disabling these permissions may limit or prevent live-tracking and other location-based features.
Location Permissions on iOS and Android
On both iOS and Android, the app uses precise location while you are using the app and requests background/Always location access only when live tracking is required for a hosting appointment. Background access is requested only after while-in-use access has been granted, and approximate-only location is not sufficient for live-tracking functionality.

I. Mobile Device Permissions
Depending on the features you choose to use, the Platform may request permission to access certain functions of your mobile device. Device permissions are requested only when reasonably necessary to provide, improve, secure, or enhance specific Platform features.
You may grant, deny, or revoke permissions at any time through your device settings. Disabling certain permissions may limit or prevent the operation of some Platform features.
The Platform may request access to:
Camera
- Capture a profile photograph (not used for facial recognition, facial comparison, or biometric verification)
- Capture photos you choose to attach to messages or support requests
- Camera access is used only to capture photos you choose to take
- Attach photos to support requests
Photo Library
- Select photographs to attach to messages or use as a profile photo
- Select a profile photo (not used for facial recognition, facial comparison, or biometric verification)
BlueberRE accesses only the photos you choose to upload or attach through supported Platform features.
Motion & Activity (Motion & Fitness / Physical Activity)
To support efficient and battery-conscious location tracking during hosting appointments, our background location provider may request motion and activity permissions. On iOS this is the Motion & Fitness permission, and on Android this is the Physical Activity permission. These permissions are used only for location-tracking efficiency and are not used for health, fitness, or wellness tracking.
Calendar
If you choose to connect your calendar, the Platform may access calendar information solely to create, modify, or manage appointments that you authorize.
Contacts
If you voluntarily grant access to your contacts, the Platform may use your contacts only for Platform features that you initiate, such as inviting another user or simplifying communications.
BlueberRE does not access or upload your contacts except as necessary to perform the feature you expressly request.
Bluetooth & Nearby Devices
Where supported, Bluetooth or nearby-device permissions may be used to improve location accuracy, facilitate approved hardware integrations, or support future Platform functionality.
Push Notifications
The Platform may request permission to send notifications relating to:
- Appointment updates
- Appointment reminders
- Account security
- Verification requests
- Messages
- Platform announcements
- Transactional Platform announcements
Notification preferences may generally be managed through your device settings.
J. Third-Party Technologies and Service Providers
The Platform may incorporate software development kits (“SDKs”), application programming interfaces (“APIs”), software libraries, cloud services, and similar technologies supplied by trusted third-party providers. These providers support functions such as background geolocation and motion/activity-based location tracking, mapping and navigation, payment processing, email delivery, backend services and authentication, phone verification and one-time-password functionality, push notifications, hosting and backend infrastructure, administrative and support tools, and basic analytics.
These technologies may support Platform functionality including:

SMS/text messages, including phone-verification codes and one-time passwords, are used for registration, verification, account security, and transactional Platform communications only. They are not used for marketing.
Depending on the services enabled, these technologies may process technical information such as:
- Device identifiers
- IP address
- Application version
- Device model
- Operating system
- Language preferences
- Session identifiers
- Diagnostic information
- Performance metrics
- Crash reports
- Approximate location derived from IP address

BlueberRE requires service providers processing personal information on its behalf to do so only for authorized business purposes and to implement reasonable safeguards appropriate to the information processed.
The specific service providers used by BlueberRE may change over time as the Platform evolves.
BlueberRE uses third-party service providers to support the Platform, including providers for background geolocation and motion/activity-based location tracking; mapping and navigation; payment processing; transactional email delivery; backend services, authentication support, phone verification, and one-time-password functionality; delivery of Platform notifications; hosting and backend infrastructure; administrative and customer support tools; and basic analytics used for administrative reporting on Platform usage. The current version of the Platform does not use artificial intelligence, automated decision-making, or machine-learning technologies.

4. No Current Artificial Intelligence Features
The current version of the Platform does not use artificial intelligence, automated decision-making, or machine-learning technologies to process personal information. If we introduce AI-assisted features in the future, we will update this Privacy Policy and provide any notices required by applicable law before using AI to process personal information.

Retention periods may vary depending on the nature of the information and applicable legal requirements. Where we have not adopted a specific retention period, we retain account information, license-verification information, messages, transactional texts, attached or uploaded photos, payment records, location data, and support communications only for as long as reasonably necessary for Platform operation, legal compliance, dispute resolution, security, fraud and abuse prevention, recordkeeping, and enforcement of our agreements, unless a shorter or longer period is required or permitted by applicable law.
8. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction.
However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
If BlueberRE becomes aware of unauthorized access to personal information, it will evaluate the incident and provide any notices required under applicable law.
The Platform may be subject to risks such as cyberattacks, hacking, phishing, social engineering, malware, impersonation, unauthorized access, and other malicious activity. You are responsible for safeguarding your login credentials and for exercising caution when sharing information with, or verifying the identity of, other users. If you suspect unauthorized access to your account or misuse of your account, you should notify us promptly at support@blueberre.com.
9. Your Choices
Depending on your location and applicable law, you may have the ability to:
- Access certain personal information we maintain about you.
- Request correction of inaccurate information.
- Request deletion of eligible personal information.
- Download certain information where available.
- Manage communication preferences where available.
- Disable location permissions through your device.
- Delete your account at any time through the in-app User Settings, subject to legal and contractual retention requirements.

We may need to verify your identity before processing certain requests. Depending on your jurisdiction, you may also have the right to appeal a decision regarding your request, and we will not discriminate against you for exercising your privacy rights.
10. Children’s Privacy
The Platform is not intended for individuals under the age of 18.
We do not knowingly collect personal information from children under 18. If we become aware that such information has been collected, we will take reasonable steps to delete it as required by applicable law.
11. Business Transfers
If BlueberRE is involved in a merger, acquisition, financing, corporate restructuring, bankruptcy, or sale of all or substantially all of its assets, personal information may be transferred as part of that transaction, subject to applicable law.
12. Law Enforcement and Legal Requests
BlueberRE may disclose personal information where it believes such disclosure is required or permitted by law, including to:
- Comply with legal process
- Respond to court orders
- Cooperate with law enforcement
- Protect the rights, property, or safety of BlueberRE, users, or others
- Prevent fraud or other unlawful activity
13. International Transfers

Users acknowledge that information may be processed in jurisdictions whose privacy laws differ from those in their home jurisdiction.

15. California Privacy Notice
If you are a California resident, you may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), depending on whether applicable thresholds are met. These rights may include the right to know and access the personal information we collect, the right to correct inaccurate personal information, the right to delete personal information, the right to obtain a copy of your personal information, and, where applicable, the right to opt out of the “sale” or “sharing” of personal information and the right to limit the use of sensitive personal information. We will not discriminate against you for exercising your privacy rights.

The categories of personal information we collect are described in the “Information We Collect” section above, including identifiers, contact information, professional and license information, commercial information, internet or network activity, precise geolocation, and user-generated content such as messages and photos. We collect this information for the business purposes described in this Privacy Policy.
Sensitive Personal Information
Under the CPRA, certain information we collect may be considered sensitive personal information, including precise geolocation and account log-in information such as a username in combination with a password. We use sensitive personal information only as reasonably necessary to provide and secure the Platform and its features, and not for purposes that would require us to offer a right to limit its use.
No Sale or Sharing
We do not sell your personal information for money, and we do not “share” personal information for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA.
Shine the Light
California’s “Shine the Light” law permits California residents to request certain information about disclosures of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
Do Not Track / Global Privacy Control
Because we do not sell or share personal information for cross-context behavioral advertising, we do not currently respond to browser “Do Not Track” signals; however, where required, we will treat recognized opt-out preference signals, such as the Global Privacy Control, consistent with applicable law.

Additional U.S. State Privacy Rights
Depending on your state of residence and whether applicable legal thresholds are met, you may have rights under other U.S. state consumer privacy laws, such as those in Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws. The rights available to you may depend on your location and applicable law.
Where applicable, these rights may include the right to confirm whether we process your personal information and to access it, the right to correct inaccuracies, the right to delete personal information, the right to obtain a portable copy of your personal information, and the right to opt out of targeted advertising, the sale of personal information, or certain profiling. We do not sell personal information, engage in targeted advertising, or conduct profiling that produces legal or similarly significant effects.
The categories of personal information we collect, the purposes for processing, and the categories of recipients are described throughout this Privacy Policy. We process sensitive personal information, such as precise geolocation and account log-in information, only as reasonably necessary to provide and secure the Platform.
Where required by applicable law, you may appeal a decision we make regarding your privacy request. To submit a request or an appeal, contact us at support@blueberre.com. We will not discriminate against you for exercising your privacy rights.
16. Canadian Privacy Notice
For users in Canada, we process personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, substantially similar provincial legislation.
Where required, we obtain meaningful consent for the collection, use, and disclosure of personal information for the purposes described in this Privacy Policy, and we provide reasonable means to withdraw consent, subject to legal and contractual restrictions. Withdrawing consent may limit or prevent your use of certain Platform features.
You may request access to the personal information we hold about you and request correction of inaccurate or incomplete information, subject to applicable legal exceptions. We maintain reasonable administrative, technical, and physical safeguards to protect personal information, and we retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy or as required by law.
We may use service providers to process personal information on our behalf, and personal information may be stored or processed outside your province or country, including in the United States. While information is located in another jurisdiction, it may be subject to the laws of that jurisdiction, including lawful access requests by courts, law enforcement, and government authorities.
